Terms and Conditions of Use

We kindly ask you to familiarize yourself with our General Terms and Conditions of Sale and Use (hereinafter referred to as "GTC") before using our website, https://secondemain.maje.com (hereinafter the "Site"), whether you intend to send us one of your Maje brand products for our trade-in service or to order a second-hand product from the Maje brand available on the Site.

Please be aware that any service conducted on the Site implies the full and complete acceptance of these GTC.

These GTC apply between you, as a consumer and non-professional, and us, Maje SAS, with headquarters located at 2 Rue de Marengo, 75001 PARIS, registered with the Paris Trade and Companies Registry under number 382 544 310. Please note that these GTC are subject to potential updates as we reserve the right to modify them at any time according to the developments of the Site and/or regulations. We want to emphasize that it is the GTC in effect at the time of your trade-in and/or purchase that will apply to you.

1. Your Customer Account

To benefit from our trade-in service for one of your Maje products (in the "sell" section on the Site) or to order a second-hand product available on our Site (in the "Shop" section on the Site), you must create a Maje second-hand customer account through the "Create an Account" section of the Site. This account must be different from your customer account on the website www.maje.com and also from your customer account on the website www.maje-location.com).

Creating your account allows you to:

  • Provide your personal information to facilitate your sales or orders of second-hand Maje products.
  • View, modify, and update your personal information.
  • Identify yourself before selling or ordering a second-hand Maje product on the Site.
  • Track your ongoing purchases and view invoices for your past orders on the Site.

By using the Site, you confirm that you are an individual residing in metropolitan France (including Corsica), Germany, the Netherlands, Spain or Belgium and you wish to benefit from our trade-in service or purchase a second-hand Maje product for personal use in quantities corresponding to the usual needs of a consumer household. Under no circumstances can our Site be used by "professional" clients. We reserve the right to refuse a sale or purchase that is evidently validated by a professional client.

You are responsible for maintaining the confidentiality of your Maje second-hand customer account and password, as well as for restricting access to your computer or other devices. By doing so, you acknowledge being responsible for all activities originating from your Maje second-hand customer account. If you suspect that your customer account is being used by a third party, we recommend changing your password and contacting us to close the usurped customer account if necessary by contacting us via the form provided here ('second hand' subject).

2. Sell your products: our second hand trade-in service for your Maje products

2.1 Which products can I sell via the Site?

Only Maje products can be sold on the Site, with the caveat that the brand label, including the size, must be visible. Products without a brand, size, or with a cut composition label (containing the article reference number) are not accepted.

We only accept second-hand products from the Maje brand, with types and sizes defined in the list provided in the automatic trade-in module accessible in the "Sell" section of the Site.

By requesting to benefit from our product trade-in service, you declare:

  • The ownership of the product and residence in metropolitan France (including Corsica), Germany, the Netherlands, Spain or Belgium.
  • Legal capacity and all necessary authorizations to offer the product for sale.
  • Contractual commitment to the truthfulness of the information provided during the product trade-in request.
  • Provision of all necessary information about the quality and condition of the product.
  • Not sending counterfeit products: The Site may request a certificate of authenticity to verify the information provided. We reserve the right to verify the authenticity of the products you wish to sell, and we will refuse a product if we believe it is a counterfeit. Thus, upon our request, you must provide the original copy and/or an electronic copy of any documentation proving ownership and authenticity of the product.

Furthermore, any Maje product for which you wish to benefit from our trade-in service must be in one of the following conditions:

New Condition : Product never worn, with or without original external tags, but retaining its internal tags.

Excellent Condition : Almost new condition, very lightly worn, without external tags but with internal tags, showing no signs of wear or visible defects.

Very Good Condition: Worn a few times, with internal tags, without major signs of wear (such as pulled threads, stains, missing buttons or rhinestones, pilling...).

The following definitions apply:

  • External Tag : The brand's commercial tag visible and attached to the product. It certifies the product reference via a unique barcode and the price.
  • Internal Tags :The label sewn inside the product. It indicates the reference, cleaning instructions, and composition of the product. The label sewn inside at the top of the product. It certifies the brand and size of the product.

We kindly ask you to verify before sending your product that it does not have any defects, holes, stains, or any signs of wear such as scratches, and that it falls into one of the three categories described above. Please note that we will not return products that do not meet these conditions. Therefore, it is your responsibility to ensure that your item meets the trade-in criteria.

Upon receipt of your item, we will verify whether the category you provided in the trade-in module matches the condition of your product and whether it still has its brand's external and internal labels intact. If this is not the case:

  • The amount of your voucher will be reduced according to the actual condition of the item, if it remains in one of the above categories and can still be resold on the Site.
  • No voucher will be issued, and your product will not be returned to you if we find upon its receipt that it has significant defects that prevent it from being resold on the Site (see section 2.3 below).

2.2 How to benefit from our Maje second hand trade-in service?

To benefit from our trade-in service for your Maje products, it's easy!

Visit our website and select the "Sell" section.

Enter the characteristics of your product by filling in the fields available in the "Sell" section of the website. Then, using the automatic calculator, obtain an estimate of our trade-in offer. This estimate is based on internal criteria (such as the type of product, the original value, the declared condition, etc.) and is generated automatically.

Select the voucher you wish to receive:

  • Voucher available on the secondemain.maje.com website, with an additional 10% on top of your voucher. This voucher cannot be used in multiple transactions.
  • Voucher available on the www.maje.com website (as a promotional code). This voucher cannot be used in multiple transactions. It can be combined with ongoing offers (except e-outlet).

For France only:

  • Voucher available on the maje-location.com website, with an additional 10% on top of your initial voucher amount. This voucher cannot be used in multiple transactions.
  • Voucher available at an eligible Maje store (excluding affiliates and department stores).

Once your trade-in request procedure is completed and you have accepted the terms and conditions, click on "Continue."

Log in to your Maje second-hand customer account on the website, or create your Maje second-hand customer account if you do not already have one.

Confirm your trade-in request.

Print the carrier label received by email to send your product.

Prepare your package, affix the label to the package, and send it free of charge using the prepaid label to a Chronopost pickup point.

Once we receive your package, we will proceed with its verification within 15 days. You will then receive an email confirming whether your product has been accepted or not, along with the associated voucher (see section 2.3 in case of refusal to sell a product).

If your package unfortunately does not arrive at our address or is damaged during transport, we will encourage you to open a claim with Chronopost. No claim or compensation can be demanded from Maje.

2.3 What happens if the condition of my product is deemed insufficient to be sold on the Site?

If your product is rejected because it is deemed to be in "poor condition," meaning it has significant defects that prevent it from being sold on the Site (such as hole(s), stain(s), scratch(es), or defect(s) affecting one or more of its functionalities), you will be notified by email no later than 15 days after sending your product.

In the case of a product in "poor condition," which cannot therefore be resold on the Site:

  • No voucher will be granted to you :
  • The rejected product will not be returned to you but will be donated to an association or recycled as part of an ("upcycling initiative").

2.4 What is the value of the voucher associated with the trade-in of my Maje product by the Site?

Once your product is validated by our services, you will receive your voucher directly by email according to the type of voucher chosen when your product was taken back. Please note that once the type of voucher is chosen, you will not be able to modify it.

We remind you that the value of the voucher may differ from the offer communicated to you by the automatic simulator if the received product does not correspond to the condition you had indicated on the Site.

2.5. How do I use my voucher?

Your voucher is valid for a period of 12 months from its issuance. To learn about the terms of use of your voucher, visit article 2.3 of our FAQ here. Please note that your voucher cannot be exchanged or refunded for cash.

3. Buying Products: Ordering a Second-Hand Maje Product on Our Site

You can order second-hand Maje products directly on our website in the "Shop" section. All products offered for sale have undergone quality control and reconditioning by us: hand inspection by our quality experts, cleaning with water or dry cleaning, and ironing. Signs of wear and/or repairs made to a product are explicitly mentioned on the product pages. Product offers and prices are valid as long as they are visible on the website, subject to availability.

3.1 How to Order a Product on the Site?

Ordering is simple!

  • Select your product, check the size, and add it to your cart. At any time, you can check the number of products in your cart and get detailed information about each item by clicking "Cart." After adding the first product to your cart, you can continue shopping by clicking "Continue Shopping."
  • Once your cart is finalized, click on "Proceed to Checkout."
  • Log in to your customer account or create one if you don't have one already, or continue as a guest.
  • Complete your shipping address.
  • Choose your payment method (see the article "How to Pay for Your Order?" below for more information on payment methods), read and accept the full terms and conditions, and proceed to securely pay for your order. Payment for your order implies full acceptance of these terms and conditions.
  • Your order is confirmed! You will receive an email confirmation of your order.

By placing an order, you declare that you are at least 18 years old and have legal capacity (or, if you are a minor, have parental authorization to place your order).

Once we've prepared your order, you will receive an email informing you that your order has been dispatched. You can then track the status of your order using the tracking information provided in the email and in your customer account. If you do not receive any (neither confirmation nor shipment notification of your order), you can contact us for more information.

It may happen that we are obliged to cancel your order for a legitimate reason, such as:

  • When you were able to place an order while the product is unavailable: we will inform you as soon as possible and refund the amount of your item promptly ;
  • When a technical error occurs during your payment ;
  • When a manifest error is made in the product description (for example, when there is an error in the essential characteristics of the product, or when a clearly erroneous price is displayed) ;
  • When we detect fraudulent or abusive use of your account or associated orders ;
  • When we reasonably believe that you have violated our terms and conditions.

3.3. How to pay for your order

You can pay for your order directly online by credit card (CB, Visa, MasterCard, American Express), or via a voucher.

After your payment is confirmed by our payment provider, your bank account will be charged the total amount of your order. If you use a voucher, the amount will be deducted from the amount of your order.

We want to assure you that all your transactions are secure and comply with current legal provisions: they take place in a strictly confidential and encrypted environment for all your data with our payment provider.

At no time we do have access to your personal data regarding your means of payment, especially credit card information, and we do not store them on our servers.

3.4. Delivery of your order

3.4.1 Where and how can you be delivered?

Your orders can be delivered to you in metropolitan France (including Corsica), Germany, the Netherlands, Spain or Belgium only through the following delivery methods:

  • Standard home delivery: Have your order delivered directly to the address of your choice.
  • Delivery to a pickup point: Have your order delivered to the pickup point of your choice.
  • Express home delivery (for France only)

You will be able to track the delivery of your order as soon as you receive the email confirming the shipment of your order with tracking information. In case of absence during the delivery of your order, for home deliveries, a delivery notice will be left to inform you of the retrieval modalities of your order.

3.4.2 When will you be delivered?

When placing your order, the delivery time for your products will be specified. Please note that it may be extended during periods of high carrier traffic.

In case of delay or non-delivery, we invite you to contact us via the form here ('second hand' subject).

3.5 What are our return and refund policies ?

To facilitate the return of your products, we grant you a total period of 30 days from the date you receive your order to return your products to us, without the need to notify us in advance of your withdrawal. Our warehouse will accept your return as long as the carrier's stamp proves that you returned the items within 30 days of receiving your order.

This period is more favorable than that provided by European regulations, which allow a withdrawal period of 14 days from the receipt of the order by a customer to notify the seller of their intention to return any product that does not suit them. The customer must then return the product without undue delay and no later than 14 days after the date of their withdrawal.

3.5.1 How to return your order to us?

The products you wish to return must be in the same condition as indicated at the time of purchase, without being damaged, stained, washed, altered, or worn (except for trying on), including the original packaging and all accessories related to the products, such as packaging, labels, as well as the original invoice.

Only returns by postal mail are possible, following the procedure below:

  • Affix the prepaid label provided in your package (please note that a fee corresponding to return costs will be deducted from your refund). Please note that we provide you with only one prepaid label. If you wish to make a second return, the return costs will be at your expense;
  • Drop off your return package at a Mondial Relay point within 30 days maximum from its receipt.

The return costs are at your expense and will be deducted from your refund:

  • France, Belgium : 5€
  • Germany, Netherlands : 5,50€
  • Spain : 6€
3.5.2 When will you be refunded?

Once your return is verified by our services, you will receive a confirmation email of your refund.

We commit to refunding you the amount corresponding to the returned product(s), minus the return costs, as soon as possible and no later than 14 days following the date of receipt of your return in our warehouses, or upon providing proof of shipment of your return.

For payments made by credit card, your refund will be credited directly to the account linked to the credit card used for the order payment. If you paid for your order with a voucher, you will be credited back with the same voucher format used when placing your order (for example, if you selected a voucher usable on the website www.maje.com, you will be credited with a voucher usable on the same website).

You will receive a confirmation email of your refund once it is validated by our systems. You can track the progress of your return directly in your customer account, under "My Orders."

Any returned product that is not in the condition it was sent to you, and instead is worn and/or soiled and/or damaged, will be returned to you at your expense and will not be eligible for a refund.

3.6. What guarantees do you have for your products?

Our products are covered by legal guarantees, namely the legal guarantee of conformity and the guarantee against hidden defects. As a seller, we have the following obligations:

  1. Conformity defects: We are responsible for the conformity defects of the products you purchase, in accordance with the provisions of articles L.217-4 and following of the Consumer Code. This guarantee applies when the product has a conformity defect, such as when the product does not work as expected or does not correspond to its description.
  2. Hidden defects: We are also responsible for the hidden defects of the products, according to the provisions of articles 1641 and following of the Civil Code. The guarantee against hidden defects applies when the product has a hidden defect, meaning a defect not apparent at the time of purchase that makes the product unfit for its intended use or significantly reduces its usefulness.

It is important to note that these legal guarantees do not apply in cases of misuse or failure to comply with the product's maintenance instructions (provided on our labels or by our alteration experts).

If you invoke the legal guarantee of conformity, you have the following rights:

  • A period of two (2) years from the delivery of the product to take action ;
  • The choice between repairing or replacing the product, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code ;
  • A dispensation from proving the existence of the conformity defect of the goods during the first twelve (12) months following their delivery, for second-hand products.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

You also have the option of invoking the guarantee against hidden defects under Article 1641 of the Civil Code. In this case, you can choose between canceling the sale or reducing the sale price, in accordance with Article 1644 of the Civil Code.

We handle your Personal Data with the utmost care and confidentiality.

5. Liability and Force Majeure

We commit to accurately describing the second-hand products we sell on the Site and to ensuring the best possible conditions for updating the information disseminated therein.

Our liability cannot be invoked in the event of a breach of any of our contractual obligations resulting from a force majeure event as defined by regulations. In particular, we will not be held responsible for any non-performance or delay in the execution of your orders caused by events beyond our control, such as:

  • Strikes, closures, or other industrial actions;
  • Civil unrest, riot, invasion, terrorist attack, or threat of terrorist attack, war (declared or not), or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disasters;
  • Inability to use public and private telecommunications networks;
  • Acts, decrees, legislation, regulations, or restrictions by any government (e.g., administrative closure of stores);
  • Failure or accidents in maritime, postal, or other transport.

The execution of the Terms and Conditions will be suspended for the duration of the force majeure event, and the execution and delivery times will be extended accordingly. However, please note that we will do our best to end the force majeure event or find a solution allowing us to fulfill our contractual obligations despite the force majeure event.

6. What if we disagree?

We hope it doesn't happen, but disagreements can arise!

Please note that our Terms and Conditions are subject to French law, and your sales and purchases of second-hand Maje products on the Site are subject to the Terms and Conditions in effect on the day of your sale or order.

In the event of a dispute, we invite you to contact us in order to seek an amicable solution together:

  • via the contact form available here, specifying the subject ‘second hand’;
  • by phone Monday to Friday from 9am to 7pm and Saturday from 10am to 5pm (number indicated on the contact form).

If no agreement is reached, you may refer the matter to the CMAP (Centre de Médiation et d'Arbitrage de Paris) for mediation:

  • using the following form www.cmap.fr/consommateurs
  • or by post to CMAP - Service Médiation de la consommation, 39 avenue Franklin Roosevelt, 75008 Paris.

Please note that any request for mediation must indicate the subject of the dispute and the documents in the file so that it can be processed as quickly as possible.

The European Commission also provides you with an online dispute resolution platform accessible at the following address:

If, unfortunately, we do not reach an amicable solution, then the French courts will have jurisdiction and French law will apply.
